New Consent Regulations August 30, 2017 As of 20 June 2017, the PA Supreme Court ruled only physicians can obtain informed consent before performing medical procedures including clinical trials. The Court’s decision is limited to the major medical procedures enumerated in the MCARE Act, which requires physicians to obtain informed consent when performing major medical procedures. The Court did not extend its ruling to require physicians to obtain informed consent for routine or nonsurgical treatments.
