US District Court Postpones Effective Date of DHS Final Rule on Duration of Status

On September 14, 2026, the U.S. District Court for the District of Massachusetts issued a preliminary injunction postponing the effective date of the Department of Homeland Security (DHS) Final Rule eliminating Duration of Status (D/S)

Under the court’s order, the Final Rule will no longer go into effect on September 15, and DHS is barred from implementing the rule. ISSS is closely monitoring the situation and any guidance issued by DHS, ICE, USCIS, and the Department of State. We will update this page and other ISSS guidance as additional information becomes available.
