Department of Homeland Security (DHS) Proposes Rule to Impose a New H-1B Fee

On August 25, 2026, the U.S. Department of Homeland Security (DHS) published a proposed rule that would establish a new $103,265 fee for each H-1B cap-subject petition. This fee would be charged in addition to all existing USCIS filing fees and other required payments 

Institutions of higher education are generally exempt from the H-1B cap. As a result, this proposed fee would not apply to Drexel University's H-1B petitions and would not affect Drexel as an employer.  

This fee is only proposed at this time and is not currently in effect. DHS has opened a public comment period and has not established an implementation or effective date.
