Professor Anil Kalhan told ABC News on March 16 that a restraining order against President Trump’s revised travel ban reflects significant evidence that the measure aimed at members of one particular faith.
"The legal standard is whether there is religious based motivation. There's so much evidence of this," Kalhan said. "The court would have to be an ostrich to deny that the new order emerged from the same context as the first one."
Kalhan was referring to the nationwide restraining order issued March 15 by Judge Derrick Watson of the U.S. District Court in Hawaii. Watson’s ruling cites interviews in which Trump and his advisers pledged to ban Muslims from entering the U.S. that indicate “religious animus” and a “discriminatory purpose.”
