In a Feb. 6 article on Colorlines, Professor Anil Kalhan commented on challenges to President Obama's executive action extending deportation deferral programs.
According to Colorlines, a Texas lawsuit is challenging the president's executive action claiming he unilaterally changed the law by offering deportation protection to youths and undocumented parents.
Kalhan, an expert on immigration law, claims that similar suits have been thrown out because they lacked the requisite link between the executive action and actual injury to the plaintiffs. However, immigration cases involve "high-profile and highly politicized set of issues," Kalhan said, implying that the Texas case may not be as open and shut. “If we were talking about the lawsuits against Obamacare at this stage I wouldn’t have guessed that they’d go to the Supreme Court.”
Should the Texas case end up in the Supreme Court "all bets are off," Kalhan warned.
