Applicability

This policy applies to all Covered Entities within Drexel University.

Covered entities are defined in the HIPAA rules as (1) health plans, (2) health care clearinghouses, and (3) health care providers who electronically transmit any health information in connection with transactions for which HHS has adopted standards.

I. Purpose

To clarify Drexel University’s (DU) right to disclose a student's immunization records.

II. Policy

DU may disclose without written authorization proof of immunization to a school, if the school is required by State law to obtain such information to admit the student. Prior to making such disclosure, DU must obtain oral agreement to the disclosure from the student’s parent or guardian (or student, if age 18 or older) and the disclosure must be limited to proof of the immunization.

III. Procedure

DU shall document in the patient's medical record the following information: (i) the date of the verbal approval; (ii) the name of the party granting the approval and such person’s relationship to the patient; (iii) to whom the disclosure was made; and (iv) the information that was disclosed.
