Drexel University Privacy Board

The mission of the Drexel University Privacy Board (Privacy Board) is to provide for the access, use and disclosure of individual protected health information (PHI) that is proposed for involvement in the research enterprise in a manner that is consistent with federal and state privacy regulations and University policy. The Privacy Board serves solely to review and approve the Privacy related documents and transactions that occur to satisfy the Health Insurance Portability and Accountability Act (HIPAA) and the Pennsylvania State Breach Act. The Privacy Board is not an Institutional Review Board (IRB).

The Privacy Board will:

  1. Review and approve Authorizations in accordance with 45 C.F.R. 164.508.
  2. Review and approve Waiver or Alteration of Authorization in accordance with 45 C.F.R. 164.512.
  3. Review and approve Preparatory to Research requests per CFR 164.512 (i) under the direction of the Privacy Officer.
  4. Review and approve Decedent Information access requests per CFR 164.512 (i) under the direction of the Privacy Officer.
  5. Issue and Execute Data Use Agreements with Limited Data Sets per CFR 164.514 (e) (2) under the direction of the Privacy Officer.
  6. Review and approve De-identification of Protected Health Information elements listed at CFR 164.514 (b) (2) under the direction of the Privacy Officer.

Membership

The Privacy Board will consist of 8 members, four ad hoc members and two ex officio members including the Executive Director, Drexel University HRPP and legal counsel. One member must not be affiliated with Drexel University.  The Drexel University College of Medicine and Drexel University Privacy Officer will Chair the Privacy Board.  An Attorney from the Office of General Counsel will serve as Ex Officio member and provide legal advice. Staff of from Human Research Protection serving in Project Coordinator roles will also be members of the Privacy Board. 

The Privacy Officers of Hahnemann University Hospital and St. Christopher’s Hospital for Children will be ad hoc committee members for the purpose of approving Limited date set, Data Use Agreements, Decedent Information and Preparatory to research documents when such is required for their institutions.

Data Breach Investigation and Response

The Privacy and Security Committee of the Drexel University College of Medicine will be delegated the conduct of investigations, remediation of reported suspected breaches and any required enforcement of federal and state regulations.  The Privacy and Security Committee serves as the breach incident response team for and is well versed in the Breach Response requirements of state and federal governing regulations and authorities. The Privacy and Security Committee is Chaired by the Chief Privacy Officer whom also chairs the Privacy Board.
